Terms and Conditions and Privacy Policy
Deeply Rooted Music School, LLC 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. Your purchase of services from this company indicates your understanding of and agreement to our Terms and Conditions and Privacy Policy. If you do not agree with these Terms and Conditions or Privacy Policy, DO NOT continue purchasing from this company. These terms are subject to change by Deeply Rooted Music School, LLC. at any time without prior written notice, in Deeply Rooted Music School, LLC’s sole discretion. 

 

Order and Payment Policies

 

  1.       Online Reservations

 

For any lessons that you wish to request, please book using our website www.deeplyrootedmusic.com/lessons. You may also contact us via email info@deeplyrootedmusic.com or phone (303) 333-0072 and Deeply Rooted Music School will respond to organize a lesson. Lessons requested, time, location, and payment are agreed upon with student contracts for services prior to lesson. 

 

  1. Lesson Payments 

 

Payments are listed in the Student Enrollment Agreement and include costs of lessons and rental fees for instruments if applicable. 

 

Payments must be made prior to the state of the class for the semester. Late fees of $10.00 per day will be assessed for late payments or late returns on rentals.

 

For any services, you can pay via cash or check upon arrival or by credit card online through a third-party payment provider including PayPal, Venmo, Wix, or QuickBooks. 

 

  1. Cancellation of Lessons and Refunds of Payments 

 

Refunds shall not be provided for cancellation of chosen classes after the class has been taken, after fifty percent of the classes on the schedule have passed, for classes that have had to change but which Deeply Rooted Music School has made reasonable accommodations, or for rentals. 

 

Deeply Rooted Music School will provide a fifty-percent (50%) refund for classes that are cancelled after the first class but prior to the halfway point in the class schedule. Deeply Rooted Music School will provide a full refund for classes cancelled more than forty-eight hours prior to the first class or untaken classes that are unable to proceed and for which Deeply Rooted Music School cannot provide reasonable accommodation

 

Cash refunds will not be given. Credit card payments are done through a third party, as such, refunds may take several weeks to process. 

 

  1. Price and Service Changes

 

Prices and services provided are agreed upon at time of Student Enrollment Agreement. Prices and services are subject to change at any time without notice prior to contracts for services being signed. 

 

Contact and Privacy Policy

 

  1. Personally, Identifiable Information

 

“Personally, Identifiable Information” (PII) is defined as information that can be used on its own or with other information to identify, contact, or locate a single person or to identify an individual in context.  Deeply Rooted Music School collects personally identifiable information in receiving your name or your children’s name, address, e-mail address, phone number, age, and other details required to provide services. Deeply Rooted Music School does not collect PII when you contact us without requesting services. 

 

  1. Other Uses of PII

 

In addition to provide services and information to you, Deeply Rooted Music School may also use your PII to improve our policies: to serve you better; to respond to customer service requests; to run contests, promotions, or surveys; to ask for ratings or reviews of our products; or to follow up with updated correspondence.

 

  1. Protecting Your PII

 

We use Gmail and MyMusicStaff to provide information to students, both of which possess industry standard security mechanisms. 

 

Your PII is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep information confidential. In addition, none of your financial information is kept in-house by Deeply Rooted Music School. 

 

We do not sell, trade, or otherwise transfer to outside parties your PII unless we provide you with advance notice. This does not include our payment platform, security advisors, and other parties who assist us in conducting our business or serving our users, so long as those parties agree to keep this information confidential.

 

We may release your PII when requested in order to comply with the law, enforce our site policies, or protect ours’ or others’ rights, property, or safety.

 

Your information is kept for no more than three (3) years after your last lesson or class with Deeply Rooted Music School.

 

Other Policies and Terms

 

  1. Notices to You

 

We may provide any notice to you under these Terms and Conditions by sending a message to the e-mail address you provide or calling the phone number you provided. Notices sent by e-mail will be effective when the e-mail is sent. Notices provided by calling will be effective upon attempt to reach the phone number.

 

  1. Notices to Deeply Rooted Music School, LLC

 

To give us general feedback, including complaints, return requests, and changes of personal information, you may email us. We will respond as appropriate.

 

To provide Deeply Rooted Music School, LLC with official notice under these terms for any conditions requiring it, e-mail notice is sufficient.

  1. Governing Law

These Terms and Conditions, your Order, and the Online Privacy Policy are governed by the laws of the State of Colorado.

 

  1. Dispute Resolution 

 

In the event of any disputes or claims arising out of or relating to your purchase of any services from Deeply Rooted Music School, LLC, you agree to binding arbitration with JAMS under the JAMS arbitration rules in Denver, Colorado. The arbitration shall be before a sole arbitrator. The arbitration shall be confidential. The prevailing party shall be entitled to reasonable costs and attorneys’ fees.

 

  1. No Waivers

 

The failure by Deeply Rooted Music School, LLC to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.

 

  1. Severability

 

If any provision of these Terms is invalid, illegal, void, or unenforceable, that provision will be severed from these Terms without affecting the validity or enforceability of the remaining provisions of these Terms.
